A Federal Judge Just Called the Pentagon’s Anthropic Blacklist “Illegal and Baseless”
U.S. District Judge Rita Lin ruled that the Defense Department's decision to designate Anthropic a national security supply-chain risk violated the company's constitutional rights, delivering a major legal win in its months-long standoff with the military.
A federal judge in San Francisco ruled Thursday that the Pentagon’s decision to blacklist Anthropic earlier this year was unlawful, siding with the AI company in a dispute that blocked it from certain military contracts.
U.S. District Judge Rita Lin vacated the Defense Department’s “supply chain risk” designation, ruling that officials violated Anthropic’s First Amendment rights by retaliating against its public stance on AI safety.
She said Officials also violated the company’s Fifth Amendment right to due process by denying it a chance to challenge the designation.
Pete Hegseth’s Designation Was a First for Any U.S. Company
The designation was unprecedented, marking the first time the U.S. government publicly applied a “supply chain risk” label to an American company, a label typically reserved for firms seen as exposing military systems.
Hegseth’s office issued the designation after Anthropic refused to allow Claude models for domestic surveillance or autonomous weapons, citing safety concerns, positions the company has defended publicly on safety grounds.
Anthropic sued in California federal court on March 9, arguing the move was less about a genuine security risk and more about punishing the company for its policy positions.
It also argued that it was never given an opportunity to challenge the designation internally before losing access to military business.
Judge Rita Lin’s Ruling Leaves No Room for Ambiguity
According to Reuters, Judge Lin’s 59-page order rejected the government’s justification, stating that “the empty invocation of national security is not a blank check to punish and retaliate against government critics,” rejecting the Department’s defense of the designation.
The government argued that Anthropic’s refusal to lift its own restrictions could create operational uncertainty and risk disabling military systems during operations.
The ruling makes clear that the court found this did not justify overriding Anthropic’s constitutional protections.
Anthropic had warned that the designation could cost it billions in lost federal business and reputational damage as government contracts become increasingly important to major AI labs.
Why This Ruling Reaches Beyond One Contract Dispute
The immediate financial impact here matters less than the precedent.
Anthropic showed no signs of slowing commercially despite the blacklist, but the ruling removes a legal cloud as the company is expected to pursue a near-record IPO and could regain access to lucrative Pentagon contracts.
More broadly, it limits how far the government can use procurement rules against companies that set boundaries on how their AI systems are used, an issue likely to grow as more AI labs draw lines around military applications.
Anthropic’s statement, per Reuters, that it remains “focused on working productively with the government” also suggests it wants to preserve the relationship while maintaining control over its safety limits.
The Defense Department’s next move, whether an appeal or a change in approach, could shape how future disputes between AI companies and Washington are handled.
